Dwarka flat to be kept aside for MLC

The Delhi HC has asked DDA to keep a flat vacant for a sitting MLC from Jammu and Kashmir in a group housing society in Dwarka after he made a plea against DDA.

Issuing notice to the DDA, Registrar Co-operative Societies and Jawahar Lal Co-operative Group Housing Societies (JLCGHS) Ltd, a division bench of Justice Madan B Lokur and Justice Sidharth Mridul sought their response by April 6 on a petition filed by P Namgyal alleging that DDA failed to allot a flat to him despite his fulfiling all formalities. Appearing for the petitioner, counsel M Tarique Siddiqui said Namgyal, a former union minister, is a resident of Ladakh region and falls under the ST category.

In February last year, the lawyer submitted that DDA asked all the flat applicants to submit either Permanent Account Number (PAN) or detail about the income tax returns with an affidavit. Even though people from Ladakh region were exempted from filing income tax returns under the Income Tax Act, Siddique told the bench that his client got his PAN card from IT department and gave it to DDA. He claimed that Namgyal was a permanent member of the society since 1983 and his membership was not cancelled on the ground of non-production of PAN.

The petitioner claimed to have made a payment of Rs 20 lakh more than the stipulated amount of 17 lakh for the three bedroom flat. Despite this, DDA did not allot him a flat when the draw of lot was held in January this year.
